These Terms of Service ("Terms") govern the use of TacTicCube (the "App"), operated by MoonLight Industries, LLC ("MoonLight Industries," "we," "us," "our"). By downloading, installing, or using the App, you agree to these Terms.
If you are under 18, a parent or legal guardian must agree to these Terms on your behalf. Because TacTicCube is designed for children, we've written these Terms with that in mind — see our Privacy Policy and Parent's Guide for how we handle children's information specifically.
1. The App
TacTicCube is a 3D tic-tac-toe puzzle game for iOS, iPadOS, and Windows, designed to help players of all ages — especially kids — practice math and strategic thinking.
2. Accounts and Profiles
TacTicCube does not require creating an account with an email address or password. Players choose a nickname to play. Progress is tied to a randomly-generated, encrypted device identifier, not to any personal information. See our Privacy Policy for full details.
3. Purchases
- Free tier: TacTicCube is free to play, supported by ads on iOS/iPadOS. The Windows version has no ads.
- Pro ($6.95, with regional pricing in select countries): a one-time purchase that removes all ads and unlocks the ability to purchase SuperPro — not a recurring charge. Once purchased, it's yours to keep.
- SuperPro ($9.95, requires Pro first): also a one-time purchase, not sold independently of Pro, with no recurring charge.
- All purchases are processed entirely through Apple's App Store (StoreKit) and are subject to Apple's own purchase and refund terms. We never directly collect or process your payment information.
- Before any purchase can begin, the App shows a parental gate (a simple math problem) in addition to Apple's own purchase protections, since TacTicCube is listed in Apple's Kids Category.
4. Referral Program
TacTicCube includes an in-house referral program that rewards players for inviting others to the App, built entirely on encrypted, anonymous identifiers (never personal information).
- Referral commissions are calculated across a five-level chain. The fifth level is always donated to Camp Gratitude, a nonprofit supporting veterans and military families, regardless of whether that slot is filled.
- Levels one through four are only paid out to a referring player who currently holds a Pro subscription. If one of those slots is empty, or the referring player at that level doesn't currently have Pro, that share is simply not paid out — MoonLight Industries retains it rather than donating it. A player who does hold an eligible slot may choose to voluntarily donate their own earned share to Camp Gratitude as well, in addition to (not instead of) the Level 5 donation.
- Commissions are provisional for a holding period (currently 30 days, subject to change at our discretion) before becoming final, to account for refunds.
- If a purchase behind a commission is refunded after that commission has already been paid out, the amount will be deducted from that referrer's next payout.
- We may change, suspend, or discontinue the referral program, or adjust its terms (including the holding period), at any time.
- Any attempt to manipulate, abuse, or defraud the referral program (such as fake accounts or self-referrals) may result in forfeiture of commissions and suspension of access to the App.
5. Classroom / Teacher Use
TacTicCube supports classroom use through a teacher-created classroom and join code, described in our Parent's Guide and Privacy Policy. A teacher who creates a classroom represents that they have the necessary authorization from their school and/or their students' parents to use the App for this purpose, and agrees to use any student progress data made visible to them solely for that educational purpose.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or tamper with the App
- Abuse the referral program as described in Section 4
- Attempt to bypass the App's parental gates or age-appropriate protections
- Use the App in any way that could harm, disable, or interfere with its normal operation for other players
7. Intellectual Property
TacTicCube, its name, logo, and all associated content are owned by MoonLight Industries, LLC. These Terms don't grant you any ownership rights — only a limited, personal, non-transferable license to use the App for its intended purpose.
8. Disclaimers
The App is provided "as is," without warranties of any kind, to the fullest extent permitted by law. We don't guarantee the App will be uninterrupted, error-free, or available at all times.
9. Limitation of Liability
To the fullest extent permitted by law, MoonLight Industries, LLC is not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us, if any, in the 12 months before the claim arose.
10. Termination
We may suspend or terminate access to the App for any player who violates these Terms, including through the acceptable-use restrictions in Section 6.
11. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify players within the App.
12. Governing Law
These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws principles.
